Court restrains EFCC, ICPC, CBB From Arresting Kano Anti-graft Boss

A High Court sitting in Kano State has restrained the Economic and Financial Crimes Commission (EFCC), Independent Corrupt Practices and Other Related Offences Commission (ICPC), and Code of Conduct Bureau (CCB) from arresting Barr. Muhuyi Rimingado, the Chairman of Kano State Public Complaints and Anti-Corruption Commission (PCACC).

 Justice Farouk Lawan, gave the order on August 28, 2023, after listening to an argument from H. I. Dederi Esq, the Attorney General of Kano State, who is the counsel to the applicant.

The order restrains the agencies from arresting, detaining, or in any way interfering with the applicant’s activities until the determination of the pending motion.

The applicant had filed the motion ex parte, which is a type of motion that is heard without the other party being present. The applicant argued that the agencies’ investigations into the PCACC’s activities are politically motivated and that they are intended to intimidate and harass the applicant.

The court granted the interim order pending the hearing of the main motion.

The applicants in the suit are the Attorney General of Kano State, the PCACC, and its Chairman, Barr. Muhuyi Magaji Rimingado. The respondents are the EFCC, the ICPC, and the CCB.

UNITY TIMES reports that the Kano State government has dragged the federal government before the state High Court over what it described as harassment and intimidation of the state Anti-corruption Commission (PCACC) by three federal agencies.

This is sequel to an invitation sent to the PCACC and its officials by the Economic and Financial Crimes Commission (EFCC), Independent Corrupt Practices Commission (ICPC) and Code of Conduct Bureau, respectively, to answer questions over the commission’s administration from 2011 to date.

In an exparte order, the court, presided by Justice Farouk Adamu, ordered the federal agencies and their agents to stop questioning or investigating officials of the PCACC.

The court also ordered the agencies to stop meddling into the matters of the anti-graft agency.

The Order with suit no K/M1128/2023, further advised all the parties involved in the case to maintain status quo.
