Supreme Court Voids Status Quo Order, Sends ADC Leadership Battle Back to Trial Court

Nigeria’s Supreme Court has ordered David Mark and other parties in the African Democratic Congress leadership dispute to return to the Federal High Court for full hearing.

In a unanimous decision led by Justice Mohammed Garba, the apex court nullified an earlier “status quo” order issued by the Court of Appeal, ruling it was improperly granted after the appeal had already been dismissed.

The case stems from a suit filed by Nafiu Bala, who is contesting the legitimacy of the Mark-led leadership and claims he should be recognised as acting national chairman.

While the Supreme Court agreed that Mark’s appeal was premature, it ruled that the appellate court overstepped its bounds by issuing preservatory orders.

The court has now reset the dispute, directing all parties back to the trial court for determination of the substantive issues.

The ruling prolongs the leadership crisis within the ADC, adding another layer of uncertainty as opposition realignments ahead of 2027 gather momentum.
